Veteran radio and club DJ Davies Mugadza, yesterday escaped jail by a whisker after he was convicted of contravening the Maintenance Act.

The 39-year-old DJ sired a son with former girlfriend Vimbainashe Ngara in 1999. In 2010 Mugadza was ordered by the Harare Civil Courts to pay $160 per month towards the child’s upkeep, to pay his school fees and to buy clothes twice a year. The father of six was now in arrears of $669 after he defied the court order. Some few years back, Ngara blew the cover on Mugadza and stunned the court by revealing that the radio personality was also getting money from private functions acting as the famous Dr Zobha. This was after Mugadza had told the court that with the salary that he was getting from ZBC, he was unable to pay what Ngara had requested.

Ngara would have none of it and unmasked Mugadza whom he said was behind the Dr Zobha character. Mugadza pleaded guilty when he appeared before Mr Tendai Mahwe. Mr Mahwe said as a first offender it was unfair to send Dr Zobha to prison. He then slapped him with a two month prison term which was wholly suspended on condition he pays the money on or before November 28. In mitigation Mugadza pleaded for the court’s leniency arguing that he was married with six children who looked up to him.

Prosecutor Ms Francesca Mukumbiri told the court that on July 6 2010 Ngara took Mugadza to the Civil court seeking an upward variation of maintenance for their son. Mugadza was ordered to pay $160 per month for the child’s upkeep with effect from July 31 of the same year. He was also ordered to pay the child’s school fees, to cater for all the school’s requirements and to buy him two pairs of casual clothes twice a year. Mugadza failed to pay part of the child’s school fees amounting to $435 and did not buy textbooks for him. Mugadza defied the court order by also failing to buy clothes for his son and to pay for his school trip.
